Welcome to Wellness Key Insight (the "App"). By downloading, accessing, or using this App, you ("User" or "you") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must immediately cease all use of the App.


1. Acceptance of Terms

By using the App, you represent that you are at least 13 years of age. Users between the ages of 13 and 18 must have the consent of a parent or legal guardian to use the App.


2. Disclaimer: Not Medical Advice

The information provided by Wellness Key Insight, including all AI-generated content (nutritional analysis, skin assessments, and wellness tips), is for informational purposes only.

  1. No Diagnosis: The App does not provide medical diagnoses, treatment, or professional medical advice.
  2. Professional Consultation: Always seek the advice of your physician or other qualified healthcare provider regarding any medical condition.
  3. Safety Protocol: If the App indicates that you should consult a professional (Safety Interruption), you must follow that guidance. Never delay seeking professional medical advice because of information provided by this App.


3. AI-Powered Services

  1. Technology: The App utilizes artificial intelligence (Google Gemini API) to process your inputs. You acknowledge that AI output is based on patterns and data and may contain inaccuracies.
  2. Use at Your Own Risk: You are responsible for any decisions made based on the AI analysis.


4. Data Security & Privacy

  1. Local Encryption: Your data is encrypted locally on your device using SQLCipher. You are responsible for maintaining the security of your device.
  2. Privacy Policy: Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.


5. Intellectual Property

All content, design, code, logos (including the Wellness Key logo), and proprietary algorithms are the exclusive property of Wellness Key Insight. You are granted a limited, non-exclusive license to use the App for personal, non-commercial purposes.


6. Limitation of Liability

To the maximum extent permitted by the laws of the State of Florida:

  1. Wellness Key Insight shall not be liable for any direct, indirect, incidental, or consequential damages resulting from your use of the App.
  2. We provide the App "as is" and "as available," without warranties of any kind.


7. Indemnification

You agree to indemnify and hold harmless Wellness Key Insight and its owner from any claims, losses, or damages arising out of your violation of these Terms or your misuse of the App.


8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Florida, and you irrevocably consent to the personal jurisdiction and venue therein.


9. Modifications to Terms

We reserve the right to modify these Terms at any time. Your continued use of the App following any changes constitutes your acceptance of the updated Terms.
